‘431 days to go until I can come home and be united with my family.’

On 19 April in the afternoon the prison
administration called us and said we could see Hu Jia on the following day. We
saw him yesterday afternoon.

He is very thin; he lost two
kilograms
while he was suffering from diarrhea in recent
weeks. But he was in fairly good spirits, smiling at us through the glass. This
managed to alleviate the shock his mother had suffered when she saw him—in shackles—in
the prison hospital on
30 March 2010. And Baobao [our daughter Qianci’s nickname] was really
lovely, too; she greeted him ‘Hello Daddy…Daddy, are you thinking of
me?…Dad, I want to eat chocolate…Dad, I want to play sticks’ in a loud
voice…when we set out from home that day, she had said in a very surly way,
‘we’re going to Daddy’s kindergarten now.’ During our conversation she
frequently interrupted us by speaking to her Daddy and that made Hu Jia really
happy.

Hu Jia’s prison life is just as before. He does not currently suffer from a
high fever or diarrhea and is taking two kinds of western medicine, one kind to
treat liver cirrhosis and another kind to treat the subclinical
hyperthyroidism. When I saw him I asked Hu Jia if he knew his HB5 and viral
load results; he said he still didn’t know; he had applied for this information
but they had not told him yet. I asked him detailed questions about his time in
hospital and he told us that they had taken 15 blood samples for tests and that
the doctor had told him that his results showed that he had subclinical
hyperthyroidism and that he wasn’t clear as to the other [tests].
 
Hu Jia was very concerned about the situation in Jyeku/Yushu and asked whether
the friends from the Wild Yak Brigade and other friends as well as the family
of the widow of Secretary Sonam Dhargye were alright. He asked me to light
incense for the victims who died in the earthquake on his behalf.
 
The half-hour meeting was over very quickly. Afterward, we met the people in
charge at the prison hospital. We asked him for Hu Jia’s HB5 and viral load
results. The person responsible for the prison hospital told us that his HB5
values were plus two or three and that the viral load measured in March was 0.5
above the normal. (If I remember correctly, the scientific method is to
multiply that figure by 10^5) but that the status of Hu Jia’s liver disease was
on the whole good. This person’s attitude was very good, he explained things
with great patience and spoke in a humane way; he made me feel that he was a
very good doctor.

But the prison and the prison hospital are still not providing any written test
results and not approving medical parole.

I once said to Hu Jia, ‘while you’re inside we cannot help you; so you really
must take good care of yourself and try and stay in good mental and physical
shape.’ He is getting through each day with a peaceful mindset and in each
letter to his family he notes how many days away he is from returning home. If
he is writing us a letter today it should be: ‘431 days to go until I can come
home and be united with my family.’

周一(419日)下午接到监狱电话通知第二天会见。昨天(20日)下午我们见到了胡佳。

 

他很瘦,前段时间发高烧和腹泻让他丢了4斤的体重。不过他的精神不错,远远地对我们笑。这淡化了330日妈妈见他时受的精神刺激。宝宝也特别乖,大声地对胡佳说:爸爸,你好……爸爸,请问你想我吗……爸爸,我想吃巧克力……爸爸,我要玩棍子……出发去监狱时,宝宝很肯定地说:我们要去爸爸的幼儿园喽!我们谈话中她也时不时插话喊爸爸,胡佳很开心。

 

胡佳的监狱生活如常,目前已经不发高烧和腹泻,在服两种西药,一种针对肝硬化病情,一种针对亚临床甲亢。见面时我问胡佳知不知道自己乙肝五项和病毒载量的检查结果,他说还不知道,申请了也还没有告诉他。我详细问他在监狱医院的过程,他说,他只知道自己被抽了15管血做化验,医生告诉他诊断结果是亚临床甲亢,其他不清楚。

 

胡佳很关心玉树的情况,问我野牦牛队的朋友和亲人安否,又问索南达杰书记的遗孀家人安否。要我代他为地震中死去的人们上香。

 

半小时的会见很快就结束了。随后监狱医院的负责人与我们见面。我们想知道胡佳乙肝五项和病毒载量。监狱医院负责人说乙肝五项经常是三项或两项阳性,3月份测的病毒载量比正常值高0.5(后面是科学计数法,如果我没有记错,是乘以105次方),但胡佳肝病的情况总体来说是好的。监狱医院负责人的态度很好,解释时很耐心,用词非常人性化,让我感觉到他是一位非常好的医生。

 

但是,监狱和监狱医院还是不能向家属提供任何书面报告。也不批准保外就医。

 

我曾经对胡佳说,你在里面,我们帮不到你,你一定要照顾好自己,保持良好的身心状态。他努力心平气和地过好每一天,每封家信上都写着回家倒计时。如果此刻胡佳在写信,应该是:离回家团圆还有431天。

These past few days, we have called
the staff members [in the prison and hospital administration] concerned with Hu
Jia’s case every day. But each time, no matter whether we were trying to reach
the prison hospital staff or the prison affairs office staff we were always
told the person we asked for wasn’t there – they had gone out, or they had just
gone into the prison compound [meaning they had left the administrative compound
and entered the actual prison], or they had gone to attend some training
outside the prison. Even if we called several times a day, we always got this
answer. And there was no point in going directly to the prison either, since
without a prior appointment we would not even have been able to get through the
entrance door of the administrative compound.  
 

We got in touch with lawyers and
legal experts to enquire if the law and legal procedures provided any room for
action. But the current law puts far too few constraints on the discretion of
the prison administration in such cases. All I can do is incessantly make new
requests [to the prison administration]; and I may also submit applications to
the Prison Administration Bureau and to the Ministry of Justice. But sadly,
ever since Hu Jia was ‘disappeared’ in 2006, I have repeatedly submitted
applications, petitions, reports and complaints and so on to the police,
prosecutorial and various other government authorities at all levels of the
administration. With the exception of the Beijing City People’s Congress Representative
Wu Jing’s response, I have not received a single answer to all my submissions.
According to Yu Tong, Ai Xiaoming’s and Cui Weiping’s urgent appeal calling for
signatures in support of Hu Jia has already been delivered by express mail to
the Beijing Prison and Beijing Prison Administration Bureau.

My requests are very simple: 1.
medical parole for Hu Jia, 2. while medical parole has not yet been granted, Hu
Jia’s living conditions should be improved and he should no longer be required
to do physical labour, 3. Hu Jia himself and his family should be provided with
all the written documentation of all the medical test results. But until now,
not a single one of these requests has been granted.

Apart
from this, while none of the relevant results
needed
to asses the state of Hu Jia’s liver cirrhosis have been made available, some
medical experts on diseases affecting the liver have advised that Hu Jia is
very likely in urgent need of new antiviral treatment. As he has already built
up a resistance to the
Lamivudine
he was given before, Adfovir or Entecavir could be used for his treatment. To a
liver cirrhosis patient who has already taken antiviral medication in the past,
any medicine such as the Silybin Meglumine pills he is now receiving is as useless
as a mere placebo.

Yesterday
afternoon Hu Jia called me on the phone. It was the first time he was in touch
since he was hospitalized on 30 March. He sounded calm and gentle. He told me
that the division head (prison officer) in charge of him had gone off for some
training, that the other officer replacing him had asked him if he wanted to
make a phone call to his family, and that this was why he was able to contact
me. He told me on the phone that when he was taken back to the prison on 9
April 2010 the doctor told him that the test result had shown he had
subclinical hyperthyroidism and that he did not currently have a high fever, and
that the state of his colecystitis and liver stones remained unchanged. The
prison was [now] giving him two kinds of medicine, namely the Silybin Meglumine
pills produced by the Hunan Pharmaceutical Ltd. Corporation, and a
medicine for treating hyperthyroidism (because of time constraints I was
unable to note down the name of this medicine). I asked him if he had seen any
written test results and he said he had not. He told me, moreover, that he had also
submitted a written application requesting that he and the family be issued
with the written test results, but his request had been rejected. I asked Hu
Jia if after his return to prison his living conditions had improved in any way
and he said there was no change whatsoever. When I asked him if he knew his HB5
and viral load test results Hu Jia said he did not know these. I very quickly
told him about the 7.1 grade earthquake in Yushu in Qinghai. (Hu Jia used to be part of the
‘Wild Yak Team,’ [a group] that tried to protect the Tibetan Antelope with a
couple of other team members on the [Tibetan] Plateau; he has many friends in Yushu County
and neighbouring areas.) He said ‘ah’ and fell silent for a moment, and then
recited ‘Amitabha [Buddha].’ We had run out of time and were cut off before we
had had time to say good-bye.

没有任何医学检查报告,不知肝硬化检查关键指标

这几天,我们每天都与监狱的相关工作人员联系,不管是监狱医务人员,还是狱政科工作人员,每次答复是:这个人不在,出去了:或者说:进院了(由行政办公区进入监狱大院)。或者说:他已经外出学习了。即使我们一天打多次电话,也是此种答复。直接去监狱也不行,因为没有预约,连监狱行政办公区的大门都进不去。

 

随时与律师联系,也咨询法律专业人士,从法律程序上有什么可为空间。现行法律对监狱行为约束性的规定少之又少,我能做的,只是不停地提出要求,也可以向监狱管理局及司法部递交申请材料。悲哀的是,从2006年胡佳失踪起,我屡屡向各级公安局、检察院以及其他政府部门提交申请、陈情、举报、控诉等文件,除了北京市人大代表吴菁老师给过我答复和反馈,其他部门及市长等人,从未给过我答复。雨桐告诉我,艾晓明老师和崔卫平老师发起的公开呼吁及签名,已经特快专递到北京市监狱和北京市监狱管理局。

 

我的诉求很简单:1.胡佳保外就医;2.实现保外就医之前,改善胡佳的生活条件,停止让胡佳从事体力劳动;3.向胡佳本人和家属提供全面的医疗检查报告。但是,到目前为止,一项诉求也没有实现。

 

此外,虽然没有任何肝硬化检查关键指标,一些肝病专业人士谨慎地建议:胡佳很可能急需新的抗病毒治疗,拉米夫定(贺普丁)已经治疗无效,可以用阿德福韦或恩替卡韦。诸如“水飞蓟宾葡甲胺片”之类的药物治疗对于已经用过抗病毒治疗药物的肝硬化病人来说,等同于安慰剂。

 

昨天下午,我接到胡佳从监狱打来的电话,这是胡佳330日入院以后我们第一次直接联系。他的语气平缓,告诉我,负责他的队长(监狱警察)外出学习没有回来,另一位警察问他要不要给家里打个电话,他因而获得与我联系的机会。胡佳在电话里告诉我,49日他被带回监狱,医生口头告诉他,诊断结果是“亚临床甲亢”,目前不发高烧了,胆囊炎胆结石等情况依旧,监狱给了两种药物水飞蓟宾葡甲胺片(湖南协力药业有限公司生产)和一种治疗甲亢的药物(时间紧迫,我没能够记下药品名称)。我问他有没有看到任何书面检查报告,胡佳说没有。他还告诉我,他也写了书面申请,要求监狱为他本人和家属提供医学检查报告,但被拒绝。我问胡佳回监狱以后,生活条件是否有改善,他说没有任何改变。我问他知不知道乙肝五项和病毒载量的检查结果,胡佳说不知道。我非常快地告诉他青海玉树发生了7.1级地震(胡佳曾经与野牦牛队的弟兄们一起在高原保护藏羚羊,在青海玉树及邻近地区有多位好友),他“啊”一声,停顿了片刻,念“阿弥陀佛”。我们来不及说再见,电话因时间限制被切断了。

保外就医申请被正式拒绝

今天(412日)早上,北京市监狱医院院长给胡佳母亲打电话,口头通知:上周五(9号)胡佳已经押回监狱,胡佳肝上长的是血管瘤,肝硬化病情不符合保外就医规定,不能保外就医,3月份发高烧腹泻诊断结果是“亚临床甲亢”。

 

我对监狱方口头转述的消息抱有顾虑。没有衡量肝硬化病人身体状况最重要的检查指标的报告:乙肝五项和病毒载量。为什么?

 

随即我与北京市监狱狱政科联系,要求提供胡佳全面检查报告的书面文件,狱政科工作人员当时拒绝。

 

48,我们在北京市监狱与监狱医院院长、狱政科工作人员及保外就医工作负责人谈话时,没有任何迹象显示胡佳第二天会出院。8日下午我公开胡佳住院的情况,并呼吁立即保外就医。

 

2009512我为胡佳向监狱提交保外就医的申请,答复是不能保外就医。

201048提交的保外就医申请,今天口头答复是:胡佳肝硬化病情不符合保外就医规定,不能保外就医。

 

20095月份以后,胡佳的所有医学检查书面报告,监狱方都不提供给家属,仅仅口头通知家属及胡佳检查结果。2006年胡佳失踪41天后胡佳第一次体检的检查报告被作假,以致延误胡佳肝硬化病情的治疗。考虑到这些情况,我非常担忧。

 

20091月,因身体产生抗药性,胡佳停用了抗病毒药物拉米夫定。此后监狱为胡佳提供的药物是“水飞蓟宾葡甲胺片”(湖南协力药业有限公司生产)。

 

我要求胡佳为自己做健康日记,在家信中,我们发现胡佳的身体状况持续恶化。胡嘉常年感冒无法康复,经常腹部绞痛、隐痛,腹泻,食欲不振,低烧,体重下降。肝硬化病情非常不稳定。330日胡佳因持续高烧、腹泻、肝上长直径约3厘米的不明物体入住北京市监狱管理局中心医院。

 

我的诉求:

1.     无论何种形式,胡佳必须早日回家治疗、疗养,以免病情持续加速恶化;

2.     胡佳在押期间,为胡佳调整监舍、提供合理的营养膳食、适合病人疗养的作息安排,不再要求胡佳从事任何体力劳动。

3.     监狱方向家属及胡佳提供完整的医学检查报告书面文件。
